The Site is intended only for visitors who are 21 years of age or older and who are located in jurisdictions where cannabis is lawful. By using the Site you represent that you are at least 21 and that your access does not violate the laws of your jurisdiction.

The Site is a marketing and informational website for our brick-and-mortar dispensary at 136½ Church Street, Burlington, VT 05401. Orders placed through our linked online menu are reserved for in-person pickup; the Site does not deliver or ship. All cannabis sales are completed in person at our licensed premises during posted hours of operation.

Cannabis products may only be sold in person to customers who are at least 21 years of age and who present a valid, unexpired, government-issued photo ID at the time of purchase. Acceptable forms of identification include a state driver's license, state-issued ID card, U.S. passport, U.S. passport card, U.S. military ID, or a federally recognized tribal ID. Other forms of ID may be accepted at our discretion subject to in-store verification. Sales to anyone under 21, anyone unable to present valid ID, or anyone who appears intoxicated are prohibited.

Due to federal banking restrictions on the cannabis industry, we accept cash and debit only. Credit cards and tap-to-pay services are not accepted. An ATM is available on-site.

Per Vermont Cannabis Control Board rules, returned cannabis products cannot be restocked and must be quarantined for disposal. All cannabis sales are final. If you believe you have received a defective or contaminated product, return to the store in person within seven (7) days of purchase with the product and your receipt; the product will be quarantined and reviewed consistent with state regulation.

Statements on the Site have not been evaluated by the U.S. Food and Drug Administration. The products offered for sale at our dispensary are not intended to diagnose, treat, cure, or prevent any disease. Nothing on the Site is medical advice. Consult your physician before using cannabis, especially if you are pregnant, nursing, taking medication, have a medical condition, or are under the care of a healthcare professional.

Cannabis use can result in a positive drug test. You assume all responsibility for the consequences of cannabis use, including consequences related to employment, child custody, professional licensing, athletic eligibility, immigration status, firearm ownership, or any other matter where cannabis use may be relevant.

Cannabis remains a Schedule I controlled substance under federal law. Sale and possession of cannabis are unlawful outside of state-regulated programs. Nothing on the Site should be construed as encouraging anyone to violate any federal, state, or local law.

Cannabis can impair concentration and coordination. Do not operate a vehicle, boat, aircraft, or machinery under the influence of cannabis.

All content on the Site — including text, graphics, logos, icons, images, and the underlying design — is owned by BB Cann Inc or our licensors and is protected by U.S. and international intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works of any Site content without our prior written consent.

You agree not to:

• Use the Site if you are under 21;
• Use the Site to violate any law;
• Scrape, crawl, or otherwise harvest content from the Site by automated means;
• Attempt to gain unauthorized access to the Site, our servers, or any related systems;
• Impersonate any person or misrepresent your affiliation;
• Interfere with the Site's normal operation or with other users' use of it.

The Site may link to third-party websites. We do not control them and are not responsible for their content, policies, or practices. Visiting a linked site is at your own risk.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BB CANN INC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify, and hold harmless BB Cann Inc and its officers, employees, and agents from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.

These Terms, and any dispute arising out of or related to these Terms or the Site, are governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and BB Cann Inc agree that the exclusive venue for any action, suit, or proceeding arising out of or related to these Terms or the Site shall be (a) the Vermont Superior Court, Chittenden Unit, or (b) the United States District Court for the District of Vermont, and no other court. You and BB Cann Inc each irrevocably consent to the personal jurisdiction of those courts, waive any objection to venue (including any objection based on forum non conveniens), and waive any right to a jury trial to the maximum extent permitted by law.

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect. These Terms are the entire agreement between you and BB Cann Inc concerning the Site.

We may update these Terms from time to time. The "Effective" date at the top of this page reflects the most recent version. Material changes will be communicated through a notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
